The AC21 requires you to have the new employer sign the AC21. What if the employer refuses to sign..??
Also does anyone have the exact wording they sent to USCIS with the AC21 letter
There is no standard legal forms to file for AC21. So, I don't think employer needs to sign anything unless you were talking about the offer letter (which would obviously be signed by both employer and employee).

You can import PDF-compatible Adobe Illustrator files (.ai) directly into an open document in your Microsoft Expression Blend project.
When you import an Illustrator file into Expression Blend, Illustrator layers, groups, and objects are converted to Expression Blend containers and objects with associated properties. Understanding how Illustrator objects are imported into Expression Blend will help you integrate Illustrator files into your Expression Blend projects more quickly and efficiently.
When you save your file in Illustrator, make sure that the Create PDF Compatible File check box is selected in the Illustrator Options dialog box. Otherwise, you will not be able to import your Illustrator files into Expression Blend.
http://expressioniq.com/wp-content/uploads/2011/02/b5_CreatePDFCompatibleFile.png (http://expressioniq.com/wp-content/uploads/2011/02/b5_CreatePDFCompatibleFile.png)
To import an Illustrator file
Open the document into which you want to import the .ai file.
On the File menu, click Import Adobe Illustrator File.
In the Import Adobe Illustrator File dialog box, locate the Illustrator file that you want to import, and click Open.
Click OK.
A new Canvas object with the same name as your imported file is added to your document. In the Objects and Timeline panel, under the Canvas object (named AvatarSymbols in this example), are all of the Illustrator objects imported as Expression Blend objects. If images are imported as a part of your .ai file, a new folder (named AvatarSymbols_Images in this example) is created in the root folder in the Projects panel to contain all the converted image files.
Note: If there are no images associated with your project, a folder will not be created in the Projects panel.
http://expressioniq.com/wp-content/uploads/2011/02/b5_ImportIllustratorFile.png (http://expressioniq.com/wp-content/uploads/2011/02/b5_ImportIllustratorFile.png)
You can also create a custom folder in the Project folder for any images that are associated with your .ai file.
To create a custom images folder
In the Projects panel, right-click the .csproj file, and then click Add New Folder.
Type a name for the new folder in the folder name box.
With the folder selected in the Projects panel, import the Illustrator file by following the steps in the preceding procedure entitled “To import an Illustrator file.”
Layers, groups, and objects
Expression Blend imports Illustrator layers and groups as nested XAML Canvas objects containing paths and images. Nested Canvas objects are used as layout containers to make them easier to work with in Expression Blend. The following information will help you understand how to work with Illustrator files after they are imported.
Layer names
Layer names are preserved for the top-level groups (Avatars in the preceding image). After you import your Illustrator file into Expression Blend, you can change the name by right-clicking the object in the Objects and Timeline panel and then clicking Rename, or by double-clicking the object name and then typing directly in the object name field.
File structure and groups
Illustrator groups do not exist in PDF-compatible files, so are not imported into Expression Blend. However, the objects contained within an Illustrator group are imported as individual objects with the same positioning as in the Illustrator group.
Object types
Images are imported as PNG files and are added to an images folder in the Project panel, and added as Image objects in the Objects and Timeline panel. Text and vector objects are imported as editable paths and appear in the Objects and Timeline panel.
Visibility and lock
Visibility settings for Illustrator layers imported into Expression Blend are preserved. However, only visible objects within layers are imported. You can change which objects are imported into Expression Blend by changing the visibility settings of the objects within each layer in Illustrator.
Lock settings are ignored.
Editable content
If the imported content is editable, you can modify the appearance of the content in Expression Blend by modifying the object properties. The following table describes Illustrator elements that are editable in Expression Blend. Use the Description column to locate the properties for the object in order to modify them in Expression Blend.
Illustrator element Expression Blend element (XAML) Description Group Canvas Illustrator groups are ignored. However, the content of the group is imported as individual objects in the Objects and Timeline panel. Text (type objects) Canvas An Illustrator type object is imported as a Canvas object named TextBlock with the original Illustrator text imported as Path objects. Text styles are imported as separate Path objects. For example, a 5-letter word with a Strikethrough style applied is imported as a Canvas object containing 6 paths, one path for each letter of the word, and an additional path for the Strikethrough style.
Stroke Path An Illustrator stroke is imported as a path with the Stroke properties mapped to the Stroke brush in the Properties panel in Expression Blend. Solid color fill Path An Illustrator solid color fill is imported as a Path with the original Fill property mapped to Expression Blend Color properties applied to a Solid color brush. Solid color brush properties are located in the Brush category of the Properties panel.
Linear gradient fill Path An Illustrator linear gradient fill is imported as a Path with the original Fill property mapped to Expression Blend Linear gradient brush properties applied to a Gradient brush. Linear gradient brush properties are located in the Brush category of the Properties panel.
Radial gradient fill Path An Illustrator radial gradient fill is imported as a Path with the original Fill property mapped to Expression Blend Radial gradient brush properties applied to a Gradient brush. Radial gradient brush properties are located in the Brush category of the Properties panel.
Image layer Image An image object in Illustrator is imported as an Image object in Expression Blend. In addition, a PNG file is added to the project. The PNG file is the source for the Image object. Custom fill OpacityMask applied to an ImageBrush Illustrator supports multiple fills for an individual object. If an additional fill is applied to an object in Illustrator, and that fill contains an alpha channel, the fill is imported as an OpacityMask applied to an ImageBrush. For best results, use only one fill acting as an opacity mask in your Illustrator file. OpacityMask properties are located in the Brushes category in the Properties panel. In addition, a PNG file is added to the project. The PNG file is the source for the ImageBrush.
Note: You can verify whether or not multiple fills has been applied to an object by viewing the object properties in the Appearance panel in Illustrator.
Clipping mask Clip property An Illustrator clipping mask is imported as a Clip property. Clip properties are located in the Miscellaneous category in the Properties panel.
Note: The Clip property has limited support in Windows Phone projects.
Illustrator feature support in Expression Blend
The following Illustrator features are supported in Expression Blend. Where noted, features can be edited in Expression Blend.
Note: Although Expression Blend supports the following Illustrator features, for best results, create your Illustrator file using only vector art.
Text
Text layers imported from Illustrator are converted to a canvas, and each character is a separate path object that is a child of the canvas. The appearance of the text is maintained, but is no longer editable as text after it is imported.
If a single text layer in Illustrator contains hard returns, the text associated with each paragraph break will be imported as a separate canvas object when imported into Expression Blend.
Note: You may experience unexpected results when you import text from Illustrator. These results can include unexpected character rotation, kerning, point sizes, and alignment.
Text styles
The following Illustrator text effects create individual paths when imported into Expression Blend.
Subscript
Superscript
StrikeThrough
Underline
SmallCaps
AllCaps
Effects
Effects are supported, but not editable, in Expression Blend. Effects are rasterized and imported as Image objects. A PNG file is used as the source for the image object, and is located in the folder that is created in the Project panel.
Gradients
Expression Blend supports the importing and editing of linear and radial gradients. Color stops are imported as gradient brushes to the Fill property of the resulting object in Expression Blend, and opacity stops are imported as gradient brushes to the OpacityMask property.
Strokes
Custom strokes are imported as individual paths.
When you save an Illustrator file in PDF-compatible format, strokes and fills are saved as separate paths. When you import a PDF-compatible file into Expression Blend, a stroke and a fill on the same object may also be imported as separate objects. However, if the stroke and the fill are identical, the stroke and the fill may be merged into a single object when imported into Expression Blend.

The AC 21 does not say anything about the salary part in the Section 106(c). But it is a guideline issued by the Director to USCIS officers on how to interpret AC 21 Section 106(c).
You could find the salary details from www.flcdatacenter.com.
I hope this helps and good luck on your greencard chase.

Here is my story:
I work for Company A. Got an offer from Company B who is a consulting company. Got placed in a project which is like 1.5 hrs away from my home (I accepted this opportunity for my GC and everything was fine). Company B filed for my LCA for the H1-B transfer. They accepted to pay all the H1-B transfer fees.
Here is my problem:
1 week after my LCA was filed, I came to know that my wife was pregnant. As per the doctor she needs some close attention and care because of her health condition(atleast for 2 months). Also, I have to take her for tests minimum once per week at a hospital which is quite opposite in direction where company B placed me (2hrs ride).
I came to a conclusion not to take this opportunity because of my wife's health and also keeping in mind how the new job will treat me (in terms of flexibility. leaving early, WFH etc - for my wife's treatment). I felt this was a genuine reason from my side.
I informed Company B about this change of plan because I cannot commute such a long distance having these constraints in mind (not good for me as well as not good for the new project).
Company B is asking me pay $3000 for some damages and they say that it is as per the contract.
To my true knowledge I did not sign any kind of contract with them neither the recruiter told me anything. Now Company B is saying that minimum 3 months is required or I have to pay for H1-B transfer and all other fees.
The offer letter that I signed clearly stated that the employment is "At Will" in nature which when asked now, Company B is saying that is for GC and Citizens (which is not mentioned anywhere in the offer letter).
The thing is that they are threatening me and they were so rough and hard when I finally spoke to them. They said that they will be sending the vouchers for me to pay them back.
I thank God for not joining this company as I came to know about their true colors now, they are so money minded and the words they spoke were so harmful. I am pretty sure they would have created more problems for some other reasons if I had joined them.
Even though I did not sign any bond, I am really scared by the way they spoke to me. Any help or advice will be greatly appreciated.
There is a new memo out which will screw the life of these pimps. Rise up and name company B here. I will suggest you a way to file a complaint with DOL.

As we all know that priority dates became current in the latest visa bulletin. My lawyer made all my paper work ready and is about to file my paperwork with USCIS today. I am not sure if we can file the application a week before it actually becomes current.
I heard some people say that it's actually allowed to file 3 or 4 days before it becomes current. I also read reports that some people's application was rejected because it was sent too early. I am not sure what to believe here. Does anybody has any information on this?
Wait till 1st July. My friend who send his application on 29th May still waiting for receipt number but other friends who filed in June first week got their receipt number.

10 days back My employer called me and asked provide some more documents , so that they can appeal to USCIS....
I was working on getting those documents, I was in constant touch with my employer...
two days back , he suddenly called me and said that as amandment is denied I have to leave US with in next two weeks and they don't want to appeal against the RFE denyl
If you call a nurse help line and tell them that "my kid living farfaraway city, he is sick, what options do I have to make him recover?" - The answer would be take him to a doctor. Same analogy applies here, Just mentioning 'some more document', 'doubts', 'working on getting those documents' does not give any of us the big picture. Consult an attorney and decide your course of action.

I'll be checking the source of this. I'll be glad if you could point me in the right direction. Thanks.
However, this does not apply to the first poster (juz4forums). But it does answer the question of the second poster(immiguy).
Suject to certain conditions, children born abroad to permanent resident mothers are permanent residents. The requirements are that such a child must be brought to the U.S. on the mother's first return trip, and this trip must occur before the child is two years of age. I think, the child in this situation does not need a visa. Please check with your lawyer.
The necessary paperwork is processed at the port of entry, based on the mother's permanent resident status and birth certificate for the child.

We need to get all these businesses to join together with Immigration voice and support us by lobbying and funding.
No Great H-1b will come here if its going to take 10-20 years to get a Green card.
I would suggest, lets have another action item to write to these companies about IV and ask for their help for Legal Immigrants that everyone needs.
This is a big thing that is missing so far.
See how the president of the Agricultural board, unions appear on TV asking for support for illegals and also get invited to Congress.
Definitely a good idea.........the first thing that needs to happen is for us immigrants to contact our own employers (and if it is a big company - they will have some section that deals with govt affairs/lobbying) ask them to support our cause through action.......
I work for a small company, but my employer is a very decent man and may provide some funds..........(Christmas season and all!).
If he chooses to donate would it be the "contribute" link?

I am a June 25th filer, and i got my receipt for 485/131/765 on Sept 10th and haven't received any EAD or AP and no LUD as well forget about FP. I called TSC multiple time and was told first to wait till 90 days of filling ,then 30 days past receipt now 4 more weeks; since they are heavily backlogged busy in issuing receipts for 485 filer.
When i contacted my lawyer he told me the same he is still waiting for the receipts for some of his clients who filed in July/August and reassured me that if or when a receipt is issued he will also get a receipt notice, and will contact me ... so don't worry to much regarding FP misplacement and relax it will come... after all it is National security, if the US is not concerned regarding it then why should you .;)
By the way my PD is March,2003
How come TSC is slow in yr case?Try giving a call to them if you get helpful IO its good.I was thinking guys who are in TSC are lucky.
infact mine is from Nebraska...my A # numbers are changed...First name Last name my lawyer has made a confusion thats also wrong interchanged. As I have EAD adjudicated I have to pay new fees for new EAD with corrected name accepting my mistake of filing with interchanged names. Thats what IO told me yesterday.
Most of my friends in NYC-applied in TSC July 2...They have got evertything by Aug end infact some of them have done FP too in sep.
I am waiting for FP so that I can request them for correction too.
Sorry for writing blah blah blah....

If you are making 200K+/yr, just bite your lip and stay put. There are very very few careers which give you such a good pay scale.
I don't think you can do a MS in CompSci with out a BS with same specialization as far as understanding subject matter goes, but you could possibly do an MS in Information systems or similar.
But it all depends on your GRE score. If you have a high GRE score with good percentile in quantitative section then you could get into a good program.
I came to canada in 2000.I have been in USA Since 2003.
I started the GC process in Ohio, moved to bay area in 2006,stated the process again, recaptured old PD( EB2 all the way). Was hoping to get GC in Aug 2008 when my PD was current for 2 months. Hope will get it this year.
After moving to bay area I saw lots of engineer, mostly software, seemed happy with jobs. Started doing some search and found that this is one of the least stressful jobs in US with great salary and growth potential. There is no more growth in my field and it is very stressful and draining.
Thanks for the views guys, would like to know if can do MS with a bachelors in non engineering field.

In any fashion of THese threads everyones comment :
"which should match/similar to your GC labor"
WHich is a very generalized statement.
I am in this boat : Please advice me on the options:
1. Pd 2004 : GCLABOR 1.5 yrs exp : Its a pretty generic Labor which says "evaluating requests , planning , designing etc" with title of Programmer analyst.
2. I have my 140 approved , 485 pending will complete 180 day mark by dec 29. Now i am NOT on EAD neither want to be.
3. I have new opportunity where company is offering me a good pay range + they are ok with filing H1b . But job role is different like " Software Architect".
Now i am caught up in saying how i am using "AC21" when i transfer H1b what happens to my AOS? what should i do to keep it alive ? what are my options ?
Kindly help i am lost. Current GC labor etc is all for future employment how am i leveraging these two. Please help .... please help.

About 25,000 PERM labors were approved in 2007 for Indian nationals. Assuming a 2.5:1 ratio of 'GC filed:Labor approved', implies that each year 62,500 GC are demanded by Indians under EB. Since only 10,000 are available (across all EB classes), this implies each year a backlog of 50,000 cases is created for Indians.
Since PD are essentially retrogressed from Nov. 2005, we can assume that since then another 100,000 Indians have joined the GC backlog. It can also be assumed that between 2001 and Nov. 2005 there must be another (atleast) 50,000 waiting for GC.
Assuming these numbers are correct, a person filing for labor today is looking to wait for atleast 15 years before getting a GC (150,000/10,000).
As for those wth PD prior to Nov. 2005 - well..... probably anywhere between 1 to 5 years .....
Comments on the analysis.........?

I meant what docs we need to make sure we have from the employer whom we will be quitting.
Any suggestion on what is the best way to quit the existing employer ? What kind of explanation would let them create least trouble when I exit.

07/09/2008: USCIS Biometric Changes For Re-Entry Permits and Refugee Travel Documents 07/08/2008
USCIS has issued revised instructions for USCIS Form I-131, Application for Travel Document. The instructions include changes effective March 5, 2008 that require applicants for re-entry permits and refugee travel documents to provide biometrics (e.g., fingerprints and photographs) at a USCIS Application Support Center (ASC) for background and security checks and to meet requirements for secure travel and entry documents containing biometric identifiers.
Q. May an I-131 applicant for a re-entry permit or refugee travel document complete biometrics outside of the United States?
A. Form I-131 instructions provide guidance for certain persons who are abroad at the time of filing to visit a U.S. Embassy or consulate for fingerprinting, although all applicants are urged to file before leaving the United States. Since certain overseas offices have the discretion to accept and adjudicate applications for refugee travel documents, although it is not mandatory that they do so, an applicant for a refugee travel document may complete biometrics outside of the United States, but is encouraged to wait to travel until his or her biometrics have been collected and the document delivered. As discussed earlier, certain overseas USCIS offices may, in their discretion, adjudicate Form I-131 filed for a refugee travel document (but not re-entry permits), where the applicant has failed to apply while in the U.S. (see 8 C.F.R. 223.2(b)(2)(ii)). However, applicants for refugee travel documents should not count on the overseas offices necessarily agreeing to adjudicate Form I-131 in all cases, particularly where it is evident that the individual could have applied while in the U.S. and attended his or her biometrics appointment. Applicants for reentry permits should attend their biometric appointment at the designated ASC. If the applicant departs the United States before the biometrics are collected, the application may be denied.
Q. Will Form I-131 re-entry permit or refugee travel document be denied if the applicant leaves the U.S. after the application has been filed and receipted but before biometrics are completed?
A. Form I-131 form instructions state, Departure from the United States before a decision is made on an application for a Re-entry Permit usually does not affect the application. However, where biometric collection is required and the applicant departs the United States before the biometrics are collected, the application may be denied. Travel is not advisable. If an applicant leaves and comes back, his or her application may be denied while abroad, and he or she may not be able to get back into the country. Even though an overseas USCIS office may, in its discretion, take the biometrics of an applicant for a refugee travel document, there is no guarantee that the office will necessarily exercise its discretion to do so. Therefore, USCIS again urges all I-131 applicants for whom biometrics will be required to file their applications well in advance of their scheduled departure dates. USCIS suggests applicants apply for a travel document at least 60 days prior to the date of travel.
So if we efile EAD and then 2 months down the line efile AP, do we have to go twice for biometrics ???
